How personal data is handled under GDPR: what the request form collects, where it goes, how long it is kept and what your rights are.

Who is responsible for your data

The data controller is HAWK.FIX — Jednoosobowa działalność gospodarcza, Warszawa, Polska. For anything concerning your data: hawk.fix.office@gmail.com, phone +48 532 481 505.

We have not appointed a data protection officer — we are not required to. You write to us directly and the person who does the work answers you.

What the estimate tool collects

The items you tick, the calculated amount and the estimated working time. Until you send the request, these stay in your browser only.

Once you send it: your preferred date and hour, the address (street, house and flat number, floor, whether there is a lift, entry code), your name and phone number, and your email if you give one.

If you choose payment by invoice: company name and VAT number (NIP).

Your own description of the fault, and up to three photos if you attach them.

We do not collect national ID numbers, health data or any other special category data. We do not ask for it, and we ask you not to put it in the description.

Photos of the fault

A photo shows part of your home, so we treat it separately. Attaching one is voluntary — without it the estimate is less accurate, but we will still take the request.

Your browser shrinks the photo before sending, so full camera resolution never leaves your device. It goes where the rest of the request goes and is deleted together with the correspondence.

We do not publish customer photos online or in advertising. If we ever wanted to show the result of a job, we would ask for separate consent, which you can refuse with no consequences.

Why, and on what legal basis

Handling the request, pricing it, agreeing a time and doing the work — Art. 6(1)(b) GDPR: steps prior to a contract, and performance of it.

Invoices, receipts and books — Art. 6(1)(c) GDPR together with tax and accounting law.

Establishing, pursuing and defending claims, for example in a complaint — Art. 6(1)(f) GDPR, our legitimate interest.

Delivering the request to a messenger outside the European Economic Area — Art. 6(1)(a) and Art. 49(1)(a) GDPR: your explicit consent. The next section explains exactly what that means.

Your request goes to a messenger outside the EEA — please read this

The form sends your request to our server at Cloudflare, and from there straight to Telegram, because that is where we receive jobs while out on the road and see them on the phone.

Telegram is operated by Telegram FZ-LLC, based in Dubai, United Arab Emirates. That is a third country for which the European Commission has issued no adequacy decision.

In practice this means your name, phone number, address, fault description and photos reach servers outside the EEA, where the level of data protection may be lower than in the EU and enforcing your rights harder.

By ticking the consent box under the form, you also consent to this transfer. You can withdraw consent at any time, but only for the future — a message already delivered will not disappear from the messenger.

Who else we entrust data to

Cloudflare, Inc. — hosting for the site and the server that receives requests. Acts as a processor under the standard contractual clauses approved by the European Commission.

Telegram FZ-LLC — the messenger the request text goes to. See the section above.

Apart from Cloudflare and Telegram the site connects to no external server: typefaces, styles and scripts are hosted on our own server, and there is no analytics and no social plugin.

Our accountant, and a law firm if a dispute arises — strictly for settlement and for pursuing claims.

We do not sell data and do not share it with anyone for marketing — ours or anybody else's.

How long we keep it

Requests, correspondence and photos: 12 months after the job ends, in case of a complaint or a question about what exactly was done.

Requests that never became a job: 3 months.

Invoices and accounting records: 5 years from the end of the calendar year in which the tax obligation arose.

After those periods we delete the data.

Do you have to provide data

No law obliges you to. But without a phone number or an email we have no way to answer, and without an address we cannot come.

The estimate tool works out a price without any data at all. You are welcome to use it and send nothing.

Your rights

You have the right to access your data, to rectify it, erase it, restrict processing, port it, and to object to processing based on our legitimate interest.

Where consent is the basis, you can withdraw it at any time. That does not affect the lawfulness of processing carried out beforehand.

Send your request to hawk.fix.office@gmail.com. We answer within one month; for a complicated matter we may extend that by two months and will tell you if we do.

You also have the right to lodge a complaint with the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, Poland.

No profiling

We do not profile you and take no decisions about you by automated means alone. The price comes from a simple calculator with an open price list, the same for everyone — not from an algorithm scoring you.

Changes to this policy

If we change how we work — the channel we receive requests through, say, or we switch analytics on — we change this document too and update the date below.
